Introduction

Welcome to BioHackMe (displayed as BioHack Pro in the App Store)!

These Terms of Service ("Terms", "Agreement") govern your use of the BioHackMe mobile application ("App", "Service", "we", "us", or "our"), developed by Mike Reavey.

By downloading, installing, or using BioHackMe, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the App - please uninstall it immediately.

Acceptance of Terms

By using BioHackMe, you represent and warrant that:

1. Age Requirement: You are at least 13 years of age (or 18+ recommended for health tracking)
2. Legal Capacity: You have the legal capacity to enter into a binding contract
3. Compliance: You agree to comply with these Terms and all applicable laws and regulations
4. Understanding: You have read, understood, and agree to these Terms in their entirety
5. Parental Consent: If you are between 13-17 years old, your parent or guardian has reviewed and approved these Terms

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BioHackMe regarding your use of the App.

Medical Disclaimer

Not Medical Advice

All information, analysis, recommendations, and AI-generated insights provided by the App are for informational and educational purposes only.

• Not a substitute: The App is NOT a substitute for professional medical advice, diagnosis, or treatment
• No doctor-patient relationship: Use of the App does not create a doctor-patient or healthcare provider relationship
• Individual variation: Health recommendations may not be suitable for your individual medical condition
• Consult professionals: Always seek the advice of your physician or other qualified health provider with any questions about a medical condition

What This Means in Practice

❌ DO NOT use BioHackMe to:

• Diagnose any medical condition
• Determine treatment for health problems
• Replace consultations with healthcare providers
• Make medical decisions without professional guidance
• Monitor serious or life-threatening conditions
• Adjust medications without doctor approval

✅ You MAY use BioHackMe to:

• Track your general wellness metrics
• Monitor trends in your health data
• Log meals and workouts for personal reference
• Learn about health optimization concepts
• Prepare information to discuss with your doctor

Never Disregard Medical Advice

Never disregard professional medical advice or delay seeking medical treatment because of something you read or see in the App.

If your healthcare provider's advice conflicts with information from the App, always follow your healthcare provider's advice.

User Responsibility

You are solely responsible for:

1. Evaluating information: Assessing the accuracy and usefulness of App data and insights
2. Health decisions: Making informed health decisions in consultation with healthcare professionals
3. Medical conditions: Understanding your own medical conditions, medications, and limitations
4. Monitoring health: Recognizing when to seek professional medical care
5. Device accuracy: Ensuring your health tracking devices are properly calibrated
6. Honest input: Providing accurate information to the App

Description of Service

BioHackMe is an iOS mobile application designed to help you track, analyze, and optimize your health and wellness for longevity.

Core Features

1. Health Data Integration

• Import health metrics from Apple HealthKit (blood pressure, HRV, sleep, weight, workouts, etc.)
• Optional integration with Oura Ring for advanced sleep and recovery tracking
• Support for continuous glucose monitoring (CGM) data
• Local storage of all health data on your iOS device

2. AI-Powered Health Analysis

• Daily personalized health insights using Anthropic's Claude AI
• Weekly comprehensive trend analysis and recommendations
• Health metric grading (A-F scale based on optimal ranges)
• Pattern detection and correlation analysis

3. Nutrition & Meal Tracking

• Photo-based meal logging with AI-powered macronutrient estimation
• Manual meal entry with calorie and macro tracking
• Frequent meals library for quick logging
• Calorie deficit calculation and monitoring

4. Fitness & Activity Tracking

• Workout logging and tracking (via HealthKit)
• Zone 2 cardio time monitoring
• VO2 Max tracking for cardiorespiratory fitness
• Active energy and basal metabolic rate monitoring

5. Progress Tracking & Visualization

• Comprehensive health dashboard with real-time metrics
• Weekly health score (0-100 based on multiple factors)
• Historical trends and charts
• Goal setting and progress monitoring

Service Availability

Platform: iOS 13.0 or later, iPhone and iPad compatible

Requirements: Internet connection (for AI analysis features), Apple HealthKit access (optional but recommended), Camera access (for meal photo logging)

Service Uptime: We strive for 99% uptime but do not guarantee uninterrupted service

User Accounts & Eligibility

BioHackMe currently does NOT require account creation. All data is stored locally on your device.

Age Requirements

• Minimum Age: 13 years old (with parental consent required for 13-17 year olds)
• Recommended Age: 18 years old for health tracking without parental supervision

COPPA Compliance

• We do not knowingly collect information from children under 13
• If you are under 13, do not use this App
• Parents: Contact us immediately if your child under 13 has used the App

Acceptable Use Policy

Permitted Uses

You MAY use BioHackMe to:

• ✅ Track your own personal health metrics and wellness data
• ✅ Log meals, workouts, and health observations
• ✅ Access AI-generated insights for educational purposes
• ✅ Integrate with Apple HealthKit and Oura Ring (your own accounts)
• ✅ Share your own data with healthcare providers (at your discretion)
• ✅ Export your data for personal use

Prohibited Uses

You MAY NOT use BioHackMe to:

❌ Medical Purposes:

• Diagnose, treat, cure, or prevent any disease or medical condition
• Replace professional medical advice, diagnosis, or treatment
• Monitor life-threatening or serious medical conditions without doctor supervision
• Adjust medications or treatments without healthcare provider approval

❌ Unauthorized Access & Security:

• Reverse engineer, decompile, disassemble, or derive source code from the App
• Attempt to gain unauthorized access to our systems, servers, or other users' data
• Circumvent security measures or access controls
• Use the App to distribute malware, viruses, or harmful code

❌ Illegal & Harmful Activities:

• Use the App for any illegal purpose or to violate any laws
• Violate anyone's intellectual property, privacy, or other rights
• Impersonate others or misrepresent your affiliation
• Harass, abuse, threaten, or harm others

❌ Commercial Misuse:

• Resell, redistribute, sublicense, or commercialize the App or its features
• Scrape, data mine, or extract data using automated tools or bots
• Use the App to compete with us or develop competing products

HealthKit Terms & Compliance

BioHackMe integrates with Apple HealthKit to provide comprehensive health tracking. Your use of HealthKit features is subject to the following terms:

Apple HealthKit Requirements

We comply with all Apple HealthKit requirements:

1. Read-Only Access: We only read data from HealthKit, never write to it
2. No Advertising: We do NOT use HealthKit data for advertising or marketing
3. No Data Selling: We do NOT sell HealthKit data to advertisers, data brokers, or third parties
4. No Unauthorized Sharing: We only share anonymized, aggregated HealthKit data with Anthropic AI for analysis
5. User Consent: We require your explicit permission before accessing HealthKit data
6. Revocable Permissions: You can revoke HealthKit access anytime in iOS Settings

HealthKit Permissions

You control which health metrics we can access. You can grant or deny each HealthKit data type individually. Revoke permissions at any time: iOS Settings → Privacy & Security → Health → BioHackMe

None of these permissions are required - the App will function with limited features if you deny access.

How We Use HealthKit Data

Local Processing: HealthKit data is stored and processed locally on your device. We read data from HealthKit to display in our dashboard and calculate trends, averages, and scores locally.

AI Analysis (Anonymized): Aggregated, anonymized HealthKit metrics are sent to Anthropic AI. No personally identifiable information (name, date of birth, etc.) is included. Only statistical summaries (averages, ranges, counts) are shared.

What We DON'T Do:

• ❌ Write data to HealthKit (read-only access)
• ❌ Sell HealthKit data to third parties
• ❌ Use HealthKit data for advertising
• ❌ Share raw HealthKit data with anyone (only anonymized summaries)
• ❌ Track you across other apps using HealthKit data

AI Services & Third-Party Integrations

1. Anthropic Claude AI

Service: AI-powered health insights and meal photo analysis

How It Works:

1. You request AI analysis (daily insights, weekly summary, or meal photo)
2. We send anonymized, aggregated health metrics to Anthropic's Claude API
3. Claude generates personalized insights and recommendations
4. We display the insights in the App

Data Shared with Anthropic:

• ✅ Anonymized health metrics (averages, ranges, trends)
• ✅ Meal descriptions and photos (when you request AI analysis)
• ✅ Relative time references (e.g., "yesterday", "this week")
• ❌ NO personally identifiable information (name, email, DOB)
• ❌ NO raw HealthKit data with timestamps

AI Limitations & Disclaimers:

• Not medical advice: AI insights are informational only, not medical advice
• Algorithmic errors: AI can make mistakes or misinterpret data
• General recommendations: AI doesn't know your full medical history
• No liability: We are not liable for decisions made based on AI insights

Anthropic's Terms & Privacy:

• Privacy Policy: anthropic.com/privacy
• Data Retention: Max 30 days (per Anthropic's policy)
• No AI Training: Your data is NOT used to train Anthropic's models

Your Consent:

By using AI features, you consent to data sharing with Anthropic. You can disable AI features in settings to keep all data local. Meal photos are sent only when you explicitly request AI analysis.

Intellectual Property Rights

Our Ownership

BioHackMe and all its content, features, and functionality are owned by Mike Reavey and protected by United States and international copyright laws, trademark, trade secrets, and patents (if applicable).

Your License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use BioHackMe for personal, non-commercial purposes, subject to these Terms.

This license allows you to:

• Download and install the App on your iOS device
• Use the App's features for personal health tracking
• Access AI-generated insights for personal use

This license does NOT allow you to:

• Modify, adapt, or create derivative works
• Reverse engineer, decompile, or disassemble the App
• Remove copyright, trademark, or proprietary notices
• Use the App for commercial purposes
• Resell, redistribute, or sublicense the App

Your Health Data Rights

You retain all ownership rights to your personal health data.

By using the App, you grant us a limited license to process your health data to provide the Service, but we do NOT claim ownership of your health information.

Fees, Payment & Subscriptions

Current Pricing

BioHackMe is currently FREE to download and use (version 1.0.0).

• No upfront cost
• No subscription required
• No in-app purchases (yet)
• No hidden fees

Future Pricing

We reserve the right to introduce premium features, subscriptions, or one-time purchases in the future.

If we introduce paid features:

1. Advance Notice: You'll be notified at least 30 days before pricing changes
2. Grandfathering: Existing free features will remain free (with reasonable usage limits)
3. Clear Pricing: Paid features will be clearly marked with transparent pricing
4. Optional Upgrades: Premium features will be optional, not required

Payment Processing

All payments will be processed through Apple's App Store, subject to Apple's terms and pricing.

Refunds

Refund requests are subject to Apple's refund policy. Contact Apple Support for refund requests: reportaproblem.apple.com

Privacy & Data Protection

Your privacy is critically important to us.

Our data collection, use, storage, and protection practices are governed by our Privacy Policy, which is incorporated into these Terms by reference.

Disclaimers & Limitations of Liability

What This Means

We do NOT guarantee:

• Uptime: The App may be unavailable due to maintenance, outages, or technical issues
• Accuracy: Health data or AI insights may be inaccurate or incomplete
• Security: While we implement security measures, no system is 100% secure
• Compatibility: The App may not work with all devices or iOS versions
• Third-Party Services: Anthropic AI, Firebase, or other services may be unavailable
• Bug-Free: The App may contain bugs, errors, or defects

Limitation of Liability

1. Health-Related Damages:

• Injuries, illnesses, or medical conditions arising from use of the App
• Adverse outcomes from following AI recommendations
• Delayed medical treatment due to reliance on the App
• Incorrect diagnoses or missed medical conditions

2. Data Loss & Technical Damages:

• Loss, corruption, or unauthorized access to your health data
• Failure of cloud backup or data export features
• Device damage or data loss from App malfunction

3. Indirect & Consequential Damages:

• Lost profits or business opportunities
• Emotional distress or mental anguish
• Loss of goodwill or reputation

Maximum Liability Cap

Our total liability to you for any and all claims arising from these Terms or your use of the App shall NOT exceed:

The amount you paid us in the 12 months prior to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless BioHackMe, Mike Reavey, and our affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to:

1. Your Use of the App: Any harm or injury resulting from your use of the App, health decisions made based on App data or AI insights
2. Violation of These Terms: Breach of any provision of these Terms, violation of acceptable use policies
3. Violation of Third-Party Rights: Infringement of intellectual property rights, violation of privacy or publicity rights
4. Violation of Laws: Violation of any applicable laws or regulations, illegal or fraudulent activity

Termination & Account Suspension

Your Right to Terminate

You may stop using BioHackMe at any time for any reason.

To terminate:

1. Uninstall the App from your iOS device
2. Revoke permissions: iOS Settings → Privacy & Security → Health → BioHackMe → Turn Off All
3. Request data deletion (optional): Email us at [email protected]

Our Right to Terminate or Suspend

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for:

1. Violation of Terms: Breach of these Terms of Service, violation of acceptable use policies, fraudulent, abusive, or illegal activity
2. Risk to Services or Users: Activities that threaten the security of our systems, attempts to hack, exploit, or disrupt the App
3. Legal or Regulatory Requirements: Court order or legal requirement, compliance with applicable laws
4. Service Discontinuation: We discontinue the App or certain features

Effect of Termination

Upon termination:

• Your license to use the App terminates immediately
• Local data remains on your device (we cannot remotely delete it)
• Cloud backup data (if enabled) will be deleted within 30 days
• Cached AI analysis will be deleted immediately

Changes to Terms

We reserve the right to modify, update, or replace these Terms at any time.

How We Notify You

When we make changes to these Terms:

1. Update "Last Updated" Date: At the top of this document
2. In-App Notification: For material changes, you'll see a prominent notice in the App
3. Acceptance Required: For significant changes, we may require you to accept before continuing to use the App

Your Options

When we update the Terms:

• Review the Changes: We encourage you to review the updated Terms carefully
• Accept and Continue: Continued use of the App constitutes acceptance of the new Terms
• Reject and Stop Using: If you don't accept the new Terms, stop using the App and uninstall it

You cannot use the App if you do not accept the updated Terms.

Governing Law & Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the United States federal law and applicable state law, without regard to conflict of law principles.

Dispute Resolution Process

We believe most disputes can be resolved amicably. Before filing a lawsuit, you agree to:

Step 1: Informal Negotiation (Required)

Contact us first to attempt to resolve the dispute informally:

• Include: Detailed description of the dispute and desired resolution
• Timeline: We'll respond within 15 business days and attempt to resolve within 30 days

You must wait 30 days after contacting us before proceeding to arbitration or litigation.

Step 2: Binding Arbitration (If Negotiation Fails)

If informal negotiation doesn't resolve the dispute, you agree to binding arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules.

Small Claims Court Exception:

Either party may bring claims in small claims court instead of arbitration (must be within the small claims court's jurisdiction - typically $10,000 or less).

Class Action Waiver

Opt-Out of Arbitration

You have 30 days from first accepting these Terms to opt-out of arbitration:

• Include: Your name and statement: "I opt out of arbitration"
• Deadline: Within 30 days of accepting these Terms

If you opt out, disputes will be resolved in court (not arbitration), but the class action waiver still applies.

Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BioHackMe regarding the App.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the invalid provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver. We may enforce any provision at any time.

Assignment

You may NOT assign or transfer these Terms or your rights under them without our consent. We MAY assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

Apple App Store Terms

Your use of the App is also subject to Apple's App Store Terms of Service. Apple is a third-party beneficiary of these Terms and has the right to enforce these Terms against you.
